Dear Mr. Johnson:

 

My client has instructed me to make one last attempt to settle with you, and attached is a revised settlement agreement for your consideration. The terms hereof are not subject to negotiation but let me point out the principal differences between this agreement and the one that we originally sent which was rejected:

 

a)      Grow will pay you the amount of $1076.11, which is the fee charged for your cash withdrawal together with the amount that you expended for the suit that you filed, even though that suit has now been dismissed. It requires a further dismissal with prejudice.

b)      You and Grow are releasing each other from any and all claims, whether or not such claims could have been raised in the suit as a claim or counterclaim.

c)       Like the first agreement, you must cease making disparaging remarks about Grow, and cease and delete existing sites and remarks made about Grow, but your failure to do so will, in this agreement, result in the imposition of liquidated damages of $7500.00; please read those paragraphs carefully.

d)      You must still close all accounts and pay those accounts in full.

e)      Each page must be initialed by you on the right corner of each page; Grow will initial the left side of each page.

 

If you wish to take advantage of this offer, the original signed agreement must be returned to me within ten days of today’s date or by Monday, July 8, 2013, and I will then have Grow sign and return an original to you. If we do not have it back by July 8, initialed, signed and notarized, as requested, we will assume that you have rejected this offer as well. Please do not communicate directly with my client again, as they will not respond. Thank you for your cooperation.
